Terms & Conditions
These Terms & Conditions ("Terms") govern your use of Swapster ("the Platform"), operated by Swapster Ltd ("we", "us", "our"). By creating an account or using the Platform in any way, you confirm that you have read, understood, and agree to be bound by these Terms.
If you do not agree with any part of these Terms, please do not use Swapster. These Terms were last updated on 05 June 2026 and may be updated from time to time. Continued use of the Platform after changes are published constitutes acceptance of the revised Terms.
Note: These Terms are a working draft and are subject to formal legal review prior to the Platform's public launch.
1. Eligibility
You must be at least 18 years old to use Swapster. By registering an account, you confirm that you are 18 or over and that the information you provide is accurate and truthful.
Swapster is intended for personal, non-commercial use unless you have entered into a separate written agreement with us for commercial use.
2. Your Account
You are responsible for maintaining the security of your account and for all activity that takes place under it. You must not share your login credentials with any third party.
You may only hold one account. Creating duplicate accounts to evade a suspension or ban is a serious breach of these Terms and will result in permanent removal from the Platform.
We reserve the right to suspend or terminate accounts that breach these Terms, at our sole discretion, with or without prior notice.
3. Listings & Swaps
Swapster is a platform that facilitates peer-to-peer exchanges between members. We are not a party to any swap agreement. Any exchange made is solely between the two members involved.
You agree that all listings will:
- Accurately represent the item or service being offered
- Not include stolen, counterfeit, prohibited, or illegal items
- Not include weapons, controlled substances, or anything dangerous
- Not include adult content, explicit material, or anything harmful
- Belong to you, or be something you have the right to offer
We reserve the right to remove any listing that we consider to be in breach of these Terms or that we consider inappropriate, at our sole discretion.
Swapster takes no responsibility for the condition, quality, legality, or suitability of any item or service exchanged between members. Members are encouraged to inspect items prior to completing a swap.
4. Prohibited Conduct
When using Swapster, you must not:
- Harass, threaten, intimidate, or abuse any other member
- Post or transmit content that is racist, sexist, homophobic, transphobic, or otherwise discriminatory or hateful
- Engage in fraud, deception, or misrepresentation
- Use the Platform for any unlawful purpose
- Attempt to circumvent any security measure or gain unauthorised access to any part of the Platform
- Use automated tools, bots, or scraping software on the Platform
- Post spam, unsolicited advertising, or promotional content
- Impersonate any person or entity, including Swapster staff
- Collect or store personal data about other members without their consent
Breach of this section may result in immediate account termination and, where appropriate, referral to law enforcement.
5. Intellectual Property
All content on the Swapster Platform — including the design, logo, copy, and code — is the property of Swapster Ltd and is protected by applicable intellectual property law. You may not reproduce, copy, or distribute any part of the Platform without our express written permission.
By uploading content to Swapster (such as photos of your listings), you grant us a non-exclusive, royalty-free licence to display that content on the Platform for the purposes of facilitating swaps.
6. Limitation of Liability
Swapster is provided "as is". We make no warranties — express or implied — as to the availability, accuracy, or fitness for purpose of the Platform.
To the fullest extent permitted by law, Swapster Ltd shall not be liable for any loss or damage — including direct, indirect, consequential, or incidental loss — arising from your use of the Platform or from any swap made between members.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for any other liability that cannot be excluded by law.
7. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from your use of Swapster shall be subject to the exclusive jurisdiction of the courts of England and Wales.
